Terms of service

These are the terms you agree to when you use Lemarc. We have tried to write them so that reading them is possible. Where a term genuinely protects one of us, it is here; where it exists only to sound serious, it is not.

The short version

  • Lemarc is in early access. It will have rough edges and we may change it.
  • Your data and your content stay yours.
  • Lemarc produces drafts and recommendations. You review them before anything goes out.
  • You need the right to the accounts you connect and the assets you upload.
  • Either of us can end the arrangement.

1. This agreement

Lemarc ("we", "us", "our") provides an AI-powered marketing workspace that helps businesses analyze and manage their marketing operations. Lemarc is operated by Matan Buganim, based in Israel. "You" means the person or business using the product.

By creating an account or using Lemarc, you agree to these terms. If you are agreeing on behalf of a company, you confirm you have the authority to do so, and "you" means that company.

Our privacy policy forms part of this agreement.

2. What Lemarc is

Lemarc is a marketing workspace. It reads performance data from platforms you connect, produces marketing material, and recommends what to do next. You decide what happens.

Lemarc does not create, edit, pause or delete advertising campaigns, and it does not change budgets or move money on any connected platform.

3. Early access

Lemarc is in early access. That means features will change, some will be removed, and things will occasionally break. We may change how the product works while you are using it.

Access is granted by application and by invitation. We may decline an application without giving a reason.

4. Your account

You are responsible for your account credentials and for what happens under your account. Tell us promptly at support@lemarc.ai if you think someone else has access.

You must be at least 18 and using Lemarc for business purposes.

Lemarc is currently single-tenant: one account, one workspace. Do not share credentials as a substitute for the multi-user access we have not built yet.

5. Connecting your accounts

When you connect an account, you confirm that you own it or are authorised to connect it, and that you may allow Lemarc to access the data in it.

If you connect a CRM containing data about other people, you remain responsible for that data. You confirm you have a lawful basis for us to process it on your behalf. We will sign a data processing agreement on request.

You can disconnect any account at any time. What happens when you do is set out in the privacy policy.

6. The platforms' own rules

Google, Meta, LinkedIn and HubSpot each have their own terms, and connecting them through Lemarc does not exempt you from those. You remain bound by them. If a platform changes its rules, restricts our access, or removes an integration, we may have to change or remove that connection, and that is not a breach of these terms.

7. Your content, and what Lemarc produces

Everything you put into Lemarc stays yours. Your brand material, your data, your documents.

Everything Lemarc produces for you is also yours. Drafts, plans, recommendations and published material: you own the output and can use it however you like, including after you leave.

Images and assets. Lemarc can generate images, and it can incorporate images or brand assets you upload or connect. You confirm that you hold the rights to any image or asset you provide, and that it does not contain personal data, the likeness of a real person without their consent, or material that infringes anyone's rights. Images are generated using a third-party AI model, and what is sent to that model is described in the privacy policy. We do not warrant that a generated image is free of third-party rights or cleared for any particular use; as with all output, you are responsible for reviewing it before you publish it (section 8).

We keep ownership of Lemarc itself, the software, and anything we build. You are granted a licence to use it while this agreement is in force, and nothing more.

If you send us feedback or suggestions, we can use them to improve Lemarc without owing you anything for them. This does not give us any right to your content or your data, which are covered above.

We may use aggregated, anonymous information about how the product is used to improve it. Never your content, and never anything that identifies you or your customers.

8. Review before you publish

Lemarc uses AI models to produce drafts and recommendations. AI output can be wrong, out of date, or confidently mistaken. It can misstate facts about your own business.

You are responsible for what you publish. Review it. This matters most where the cost of being wrong is high: regulated claims, pricing, legal or medical statements, and anything that goes into an advertisement.

We do not warrant that anything Lemarc produces is accurate, compliant with any law or platform policy, or fit for a particular purpose.

9. Acceptable use

Do not use Lemarc to produce or publish anything unlawful, deceptive, defamatory, or infringing on someone else's rights. Do not use it to generate spam or to harass anyone. Do not attempt to break, overload, reverse engineer or extract the underlying models from the service. Do not use it to process sensitive categories of personal data, such as health or biometric data. Do not upload or connect images or other assets you do not have the right to use, and do not submit images of real people without their consent.

If you do any of this, we may suspend your account.

10. Fees

Pricing is agreed with you before your account is opened. If we change your price, we will give you at least 30 days' notice and you can close your account before it takes effect. Fees already paid are not refundable except where the law requires it.

11. Availability

We aim to keep Lemarc running, but we do not offer a service level agreement during early access. There will be downtime, planned and unplanned. Connected platforms have their own outages and rate limits, and when they are unavailable Lemarc cannot read from them.

12. Ending this agreement

You can close your account at any time by emailing support@lemarc.ai.

We may end this agreement with 30 days' notice, or immediately if you breach section 9, if you do not pay, or if we are legally required to.

When the agreement ends, you can ask us for a copy of your content and we will provide it. After that, your data is deleted as described in the privacy policy.

13. Warranties

Lemarc is provided as it is. Beyond what we have promised in these terms, we make no warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

Nothing here excludes liability that cannot be excluded by law.

14. Liability

Neither of us is liable to the other for indirect or consequential loss, lost profits, lost revenue, lost data or lost business opportunity.

Our total liability to you under this agreement is limited to the amount you paid us in the 12 months before the claim arose.

This does not limit liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit.

15. Indemnity

You will cover us against claims arising from your use of Lemarc in breach of these terms, from content you publish, or from data you connected without the right to do so.

16. Changes to these terms

We may update these terms. If a change materially affects you, we will email you at least 30 days before it takes effect. Continuing to use Lemarc after that means you accept the new terms. If you do not, close your account.

17. Governing law

These terms are governed by the laws of the State of Israel, and the competent courts of Israel have exclusive jurisdiction over any dispute. Before going to court, both of us agree to try to resolve things by talking, starting with an email to the address below.
